Orders will continue to be accepted throughout the holiday period.
Dispatch will resume from Monday 5th January.

Pre-order Policy

These terms apply only to consumer / retail purchases from our online shop. They do not apply to wholesale or trade customers. Trade customers should see our Trade Terms.

This Pre-order Policy forms part of your contract with us together with our Consumer Terms and Conditions. If there is any conflict between this Policy and the Consumer Terms on a matter of your statutory rights, the Consumer Terms and the law prevail.


1. About this Policy

1.1 A pre-order is an order for Goods we offer for sale before they are available for dispatch (for example, an upcoming trading-card or collectible release).

1.2 Pre-orders are distance sales of goods. They are not a “proxy service”, purchasing-agent arrangement, or other service contract used to remove your rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (CCR).

1.3 Nothing in this Policy affects your statutory rights under the Consumer Rights Act 2015 (CRA), the CCR, or other applicable UK consumer law.


2. How a pre-order Contract is formed

2.1 Placing a pre-order is an offer by you to buy the Goods subject to our Consumer Terms.

2.2 The Contract is formed when we send you an email confirming that we have accepted your Order (or when we dispatch the Goods, if earlier), as set out in clause 5 of the Consumer Terms.

2.3 Payment timing is as shown at checkout or on the product listing (for example, payment when you order, or closer to release). We will not take payment in a way that conflicts with the information we give you at checkout.


3. Release and dispatch dates

3.1 Estimated release, street-date and dispatch dates shown on the website or in emails are indicative only and may change (for example, because a publisher delays a release or our allocation is revised).

3.2 We will use reasonable endeavours to update you if we become aware of a material delay.

3.3 Where a publisher or rights holder notifies an official street date or on-sale restriction, we will not dispatch before that date where we are required (or reasonably expect) to observe it. Early dispatch is not guaranteed.


4. Your cancellation rights (cooling-off)

4.1 For most goods bought at a distance, you have a legal 14-day cooling-off right under the CCR. That period generally starts the day after you (or someone you nominate) receive the Goods — see clause 9 of our Consumer Terms and Conditions.

4.2 The cooling-off period for pre-ordered goods therefore usually runs from delivery, not from the date you place the pre-order.

4.3 Before dispatch: you may cancel a pre-order by contacting us at help@invictatcg.co.uk. We will refund any amounts already paid for those Goods without undue delay. We do not charge percentage cancellation fees, restocking fees or similar deductions that would conflict with your CCR rights.

4.4 After delivery: your cooling-off and return rights are as set out in clause 9 of the Consumer Terms and our Refund & Returns Policy.

4.5 We will not rely on wording that treats a pre-order as a “service fully performed” (or similar) in order to remove cooling-off rights that apply to goods. If the law ever requires a clear express request from you before a right is affected, we will only proceed where that request is clear and we acknowledge it.

4.6 Collectible sealed product that remains sealed is not automatically excluded from cooling-off merely because it is collectible. We only treat a return as outside cooling-off where a legal CCR exception clearly applies (see Consumer Terms clause 9.4).


5. If we cancel a pre-order

5.1 We may cancel or reduce a pre-order if, for example:

(a) the publisher cancels or delays the product indefinitely;

(b) we cannot obtain the Goods on reasonable terms;

(c) there is a material delay we cannot resolve; or

(d) there is a pricing or description error we need to correct before dispatch.

5.2 If we cancel, we will refund any amounts you have paid for the cancelled undelivered Goods without undue delay, and we will not charge a cancellation fee.


6. Faulty or misdescribed Goods

6.1 Your rights if Goods are faulty, not as described, or not fit for purpose are set out in clause 11 of our Consumer Terms and Conditions (Consumer Rights Act 2015). Those rights are not affected by this Policy.

6.2 To raise a fault claim, contact help@invictatcg.co.uk with your Order details and a description of the problem (photos help). We will explain the next steps.

6.3 Damaged packaging for collectibles is assessed fairly under Consumer Terms clause 11.3 and our Damaged Product Policy. We do not use an absolute exclusion of responsibility for packaging damage on consumer sales.
